Why is AML/CTF training important?
Venues with electronic gaming machines and TAB agencies are required to comply with the Anti-Money Laundering & Counter Terrorism Act. As part of the legal obligations, members of the board and senior management must be aware of their governance and legal obligations in order to ensure the venue is complying with the legal requirements.
AUSTRAC is the federal government agency that administers the AML/CTF legislation.
What are the consequences of not complying with the AML legislation?
Non-compliance to AML/CTF legislation can lead to:
- Investigation by AUSTRAC and other federal agencies
- Large fines/jail terms for company, directors and individuals
- Media attention/reputation damage to the venue
AUSTRAC has the ability to prosecute businesses, officers of the company (directors etc.) and individuals for breaches of the Act. This is why it’s so important to do this training so you understand your obligations as a board member / director, and ensure the required controls are in place.
Venues / organisations can be fined up to $31 million for a breach of the legislation.
Individuals can be fined up to $6.2 million and be sent to jail for up to 10 years.
Some recent prosecutions are below:
TABCorp – fined $45 million in 2017
Commonwealth Bank – fined $700 million in 2018
Westpac Bank – fined $1.3 billion in 2021
